Title theft. Does Essex County offer notice of change?

Jul 24, 2025 at 11:31pm

Union County clerk's office has a setup to notify property owners if there is a change to the title.

Shouldn't the notification be made at the point where there is a request to change the title?  Once the title has been changed, it may be very difficult for the legitimate property owner to take action to restore their claim to the property.

I'm not sure that would be possible in all cases. Suppose the property owner is out of town.

But the question is, if the clerk's office makes any attempt at all to notify.

Point is once the title holder has changed it may be too late.

From ChatGPT:
"As of legislation from 2022 (the “Property Owner’s Protection Act”), county recording officers are required to notify the transferor when a deed is recorded in their name. This comes with a small fee (typically around $)."

Here is the state law:

How does this legislation protect property owners in the event that someone tries to steal their property by submitting a fraudulent application for title change?

That's a great question for Renee Burgess, Garnett Hall, and Cleopatra Tucker.
