Shooting on Springfield Avenue - Letter from Superintendent

I received an email from the office of the Superintendent today. I'm not sure if the community as a whole got any such communication.

Apparently there was a shooting on Springfield Avenue. According to police it was a domestic related incident, the suspect is in custody and there is no reason to believe there is any ongoing threat to public safety.

I was at that location at about 9 am visiting the 911 memorial and wondered why the street was closed off with caution tape and at least six police vehicles were on the scene.  Thanks for the information.

Have the police or Township made any announcements regarding this incident?

I live in South Orange so if there was a Township communication it wouldn't likely come to me.

“This is a domestic related incident,” reported Maplewood Police Chief
Jim DeVaul. “The suspect is in custody and there is no reason to believe
that any further danger exists.” from https://villagegreennj.com/police-and-fire/shots-fired-on-springfield-avenue-in-maplewood-suspect-in-custody/

Kudos to the Maplewood Police department for the quick apprehension of an armed and dangerous suspect.

Do you think the perp passed her background check?

What are the odds that the perp has a NJ Firearms ID card and a pistol permit?

What is the likelihood that the weapons charges (namely, [illegal] possession of handgun) will be the first charge dropped when the perp likely accepts a plea?

When I lived down south a friend had five legal handguns in his truck when it was stolen.  I wonder if the perp used one of those guns.

As you seem to know, odds are the weapon was illegally obtained.   More severe charges are usually the ones dropped in a plea, not lower ones.

I think that you are agreeing with me that the illegal handgun possession charge will likely be dropped in a plea agreement.

Yea, whatabout the fact that antique firearms (or firerarms that are built currently but use old technology), including revolvers, can be purchased through the mail without any type of check.  And, whatabout these firearms firing real bullets.

PS Perhaps the perp (described above) used your friend's truck to get to the scene of the incident.  Does that make your friend an accessory for providing the truck (because he did not adequately secure the truck)?

No, since I read the article about what the crime is.

Now, I am really confused.  Please tell us all more about "what the crime is"?

==================================================

I read the article AGAIN.  Here is a quote from the article ( https://www.rlsmedia.com/article/update-maplewood-chief-devaul-thanks-residents-assistance-capture-domestic-violence-shooting):  "The officers heroically appended [sic] the armed suspect and took her into custody without injury to her or any members of the public."

Additionally the above referenced article also states the following:

"Chief Jimmy DeVaul said Ms. Nyesha Allen is currently remanded to the Essex County Correctional Facility and being charged with:

Criminal Attempted Murder
Endangering the Welfare of a Child
Possession of Handgun
Possession of Weapon Other
Possession of Weapon for Unlawful Purpose (2)
Receiving Stolen Property

According to Chief DeVaul, the victim is receiving treatment at University Hospital in Newark and currently is in stable condition."

PS Is there a different article that you are reading from?  If so, please provide a link.

Please explain yourself.  You have asserted that you know "what the crime is"?

Which at a minimum implies that the crime is not easily, or perhaps, readily discernible.

PS Will you acknowledge that you agree that:  the illegal handgun possession charge will likely be dropped in a plea agreement (if the State and perp can come to terms).

Nohero writes that the more severe charges are usually the ones dropped in a plea.  There are charges listed in the article which are far more serious than illegal possession of a firearm.

Nohero writes that the more severe charges are usually the ones dropped in a plea.  There are charges listed in the article which are far more serious than illegal possession of a firearm.

And there are number of lesser charges such as possession of a weapon (in this instance, a knife I believe).  Illegal possession of a handgun is a Graves Act Offense (a 2nd degree felony) for which the penalty is 5 years in the NJ penitentiary (with a minimum of three years served before becoming parole eligible). Charges so far (with my analysis of degree of felony):

a.  Criminal Attempted Murder:  could be 1st, 2nd or 3rd degree depending on additional facts surrounding the incident.

b.  Endangering the Welfare of a Child:  appears to be 2nd degree

c.  [illegal] Possession of Handgun (AKA Graves Act Offense):  2nd degree

d.  Possession of Weapon Other:  4th degree

e.  Possession of Weapon for Unlawful Purpose (2):  2nd degree for the gun and third degree for the knife.

f.  Receiving Stolen Property:
4th degree if property is worth less than $500.  Third degree if over $500 and less than $75000.

Seven charges: a, b, c, d, e1, e2 and f.  [illegal] Possession of Handgun (AKA Graves Act) is the only for which the judge has no discretion and this charge is tied for the highest charge.  IMHO, unlikely that perp will be charged at first degree level for attempted murder.  Thus, a, b, c and e1 are tied as second degree charges.  While d is a 4th degree charge, e2 is a 3rd degree charge and f is a 3rd or 4th degree charge.

Thus, the most severe charges are tied (namely,  a, b, c and e1) for severity.  Thus, the implication of nohero's posting is false (based on joan crystal's analysis we understand that nohero is asserting that the more severe charges are usually the ones dropped in a plea and nohero suggests that the Graves act offense is one of the less serious charges).

And why on earth does a school find it necessary to communicate about a case like this?????

Sorry I got today confused with April 1 based on your posting.

This is inaccurate. NJ considers BB guns and flintlocks from the Revolutionary War as “firearms” and treats them as such.

If you shoot a soda can with a red ryder BB gun in your back yard, the law considers it identical to firing a .50 BMG from your brownstone in Hoboken.

Also fun fact- sling shots are completely illegal in NJ and can net you a felony charge. Apparently back in the 30’s a clerk wrote “sling shot” instead of “slung shot”, which was a sap used commonly at the time to rob people, and today the law is still on the books, making Dennis the Menace a felon.

When people say NJ’s firearms laws are the strictest in the nation, they are not kidding.

Thanks for your update.  In my prior post,  I was referring to federal law on the antique firearm exception (both original and modern firearms with pre-1900 technology).   Clearly, NJ does not recognize this exception.

More interesting in my opinion is how "slung shot" became "sling shot" in the NJ statute.

PS Back in the bad, old days, a sock-full-of-nickels (a form of slung shot) was the weapon of choice of the local hoodlums (just reporting on my recollections - never personally involved) in this area.

PPS When I was a kid, every cop carried a blackjack (a form of sap where lead shot is wrapped in a leather container).  Thankfully, it has been years since I last saw a cop carrying a blackjack.

What you’re referring to as a black jack is the same, from what I gather, as a  “slung shot”. The legislative aid apparently wasn’t familiar with “slung shot” and “fixed” it to something they were familiar with.

I have attached a pic of what the cops used to carry (when I was a kid and young adult) and also provided a link to a vendor (apparently somebody is still buying these).  See:  https://d3protection.com/saps-and-blackjacks

PS I think you are right as to these blackjacks (AKA saps) would be considered slung shot under the weapons statute cited above.

Ever wonder why there are so few illegal cars.  They have to be registered at each point of Title transfer. Owners have to carry insurance.  And who wants to allow someone else to use the car when it is still registered to them, and insured by them.  It's a manufacturing & distribution issue.  Treat it as such.

Aside from the constitutional issue- you need to do those things to take your car off private property and into public places. Are you suggesting allowing the same sort of scheme for guns? I think there are gun owners in NJ that would support you.
